KWUA files lawsuit against Reclamation

Herald and News 4/12/19

Klamath Water Users Association, which had announced its intent to file suit last week, did so against Bureau of Reclamation on Thursday due to limitations to water supply for the Klamath Project outlined in the 2019 biological opinions.

The association, in addition to Shasta View, Klamath Drainage District, Van Brimmer Ditch Company, Ben DuVal and Rob Unruh, filed in federal district court in Medford.

The Plaintiff’s claims are based on section eight of the Reclamation Act of 1902 and seek “declaratory and injunctive relief and other relief not including money damages.”

“This action involves claims that federal officers or agencies have acted, are acting, or will act unlawfully in matters related to the Klamath Project, a federal reclamation project,” according to the filing. “... Defendants have acted arbitrarily and capriciously, abused discretion, and acted in excess of statutory jurisdiction, authority, or limitation.”
